Our client dislocated his shoulder following slipping on a wet floor in a country club where we secured a full and quick admission of liability. We sent our client for an examination with a top shoulder surgeon who prepared an initial draft report which noted a good recovery following surgery. However, we explored the potential risk of future complication with the expert and his final report indicated that our client was at risk of future complications, and indeed it was likely that in a further 20 – 30 years he would struggle to keep up with DIY and heavier chores.
The insurers failed to make any offers so court proceedings were issued. The insurers instructed solicitors to represent them who promptly made an offer to settle. This was rejected, but negotiations were swiftly concluded with our client receiving compensation in excess of £30,000 and within 2 months of issuing court proceedings. The final amount included a considerable allowance for the complications which were not expected for up to 30 years in the future.
