Our client was a motorcycle rider who suffered modest injuries following a collision on a roundabout. Although he believed that he was in the correct lane for his intended exit, dashcam footage was provided that indicated that he had drifted from his lane and into collision with the third party vehicle.
In spite of the dashcam footage, we analysed the relevant caselaw and presented a court case based on a shared liability basis. The Defendant’s solicitors adopted aggressive tactics including threatening to strike out our client’s claim for it having no basis in law. When we went to trial, not only did we secure in our client’s favour on exactly the terms we had presented it, but the client was awarded enhanced damages due to the defendant’s conduct in not accepting our arguments and running the matter to an unnecessary trial.
