Our client first contacted us in late 2022 following a country club where he slipped on a wet floor left due to their being no dry or safe route from the swimming pool to the changing rooms. Our client suffered a dislocated shoulder.
We secured a prompt admission of liability and sourced an Orthopaedic Surgeon with a specialism in shoulder injuries. Although our client’s shoulder had initially relocated back into place, he required surgery to stabilise the joint.
All appeared well, and our expert accepted that the client had made good progress following the surgery, to the point where a complete recovery was predicted within a couple of years of surgery. However, based on our experience of the future pathway following similar injuries we explored the possibility of future deterioration in the shoulder joint over the next 30 years. The expert reported on the future risks following such an incident and surgery, and following careful interview with our client we prepared a detailed case to allow for future assistance and possible expenses.
Following negotiations with the responsible insurers, we were not satisfied with the offers that they made, so court proceedings were issued. Within 3 months of issuing court proceedings, we negotiated settlement at in excess of £30,000, and repayment of the costs of private surgery. The whole matter was concluded in less than 12 months.
Having suffered this very painful injury, which required surgery, Clarity were able to secure a payout which would cover any possible future physio or support if the injury deteriorated.
